The 4 Basic Rules of Copyright
- Anything older than 1923 has
no copyrights whatsoever and is part of the public domain.
- There are no copyrights in
relaying facts.
- A copyright is violated when
the market value of the material used is diminished.
- Written permission ensures
compliance of copyright laws.
Copyright law before 1978
- The material must both show
a copyright notice and be registered for protection. No
claim of copyright exists if the material was distributed or
published* without a copyright notice.
- If the material exhibited a
copyright notice and was registered, then the material is
protected for 28 years and can be renewed for another 28 years:
total of 56 years. Renewal for the additional 28 years must
be filed within 2 years of expiration.
- After 1978, Copyright was
extended to a total of 75 years.
*"Published"
means distributed to the public in any manor or form.
Current Copyright Law, after 1978
- After 1978, any material created
or written is automatically protected by Copyright. No
registration is required.
- Registration costs $10 (1996)
Using Copyright Material
- It is okay to paraphrase
copyright material.
- It is okay to put copyright
material into your own words.
- It is okay to use indirect
quotes of copyright material.
- In quoting material, it is
always good to give credit to the author.
Fair Use Provision
- The Fair Use Provision
protects the users' right to copy copyright material.
- The user has right to copy
copyright material as long as it is used for scholarship or
research; this is not an infringement of copyright
protection
- The user is not restricted
from publishing or selling his/her scholarship or research.
